Please ensure you read and understand these terms and conditions as they apply to all orders place with Chroma Sparks.

PRODUCTS AND SERVICES

 

Chroma Sparks provides metalwork fabrication and decorative finishes for domestic, retail, leisure and hospitality settings. Our services include design, fabrication and installation. We may be required to produce bespoke work from drawings and customer specifications.

In such a case we take no responsibility for the dimensions stated, accuracy, design integrity, fixing method and suitability of the items/services we are asked to produce. We highly recommend the customer has these things checked and approved professionally prior to utilising our products and services.

 

Chroma Sparks may offer informal advice or make suggestions in relation to a customer’s project and/or requirements if we feel it may be of benefit to the customer. However, this is not professional, qualified or formal advice and so take no responsibility on the outcome and suitability of the products/services provided based upon this advice. It is the customers responsibility to determine the suitability, usability, safety, and legal requirements of products/services we are asked to provide.

 

FIXINGS AND INSTALLATION

 

If our products are to be fixed, mounted or adhered to any walls, substrates, timber carcasses, metal frames or other surfaces not provided by Chroma Sparks, then it is the customers responsibility to ensure these surfaces are suitably prepared, safe, comply with legal specifications, accurately made and are suitable for use.

 

Determining the suitability of the fixing method employed is the responsibility of the customer. This may involve the need to test fixing methods beforehand especially if load bearing considerations are important or seek professional advice/services before fixing our products.

 

OUR METAL FINISHES

 

We create decorative finishes on brass, steel, copper, bronze and other metals and surfaces. We have a range of finishes we offer, and we also create bespoke finishes based on the customer’s requirements.

 

All the finishes in our range are for reference purposes only as a visual guide and do not represent the actual product created for the customer.

Our methods employed to create our finishes are subject to numerous chemical and environmental variables that can alter the application and appearance of the finish produced.

 

Whilst we make every effort to create finishes close to our understanding of what the customer has expressed, they require, we maintain that this can be subject to interpretation, opinion and individual taste. Our products and services should only be utilised if the customer is aware and accepting of this. We carry out the method of producing our finishes based upon our interpretation of what the customer is trying to achieve and our prior experience of creating decorative works.

CHANGES OVER TIME AND THE NATURE OF METALS

 

The products we provide may alter in appearance over time. Whilst we make every effort to preserve our finishes with protective coatings such a wax or clear coat lacquer, metal by its nature will alter in appearance over time. This may be due to several variables such as physical use/handling, moisture, atmospheric changes/conditions, oxidisation, spillages or coming into contact with chemicals, water or other substances that may affect appearance.

 

These changes could result in water streaks, natural patina, blemishes, pitting, colour change, and staining/markings.

Chroma Sparks does not accept any responsibility for any of the changes listed above as they are largely out of our control.

 

At Chroma Sparks we appreciate and celebrate the natural beauty and character resulting from the above changes to our metals. The changing appearance and developing of patina over time allows the metal to develop on its own which we feel should be embraced. If the customer doesn't share this appreciation, we do not recommend they utilise our products and/or services.

 

 

SAMPLES

 

Chroma Sparks may choose to sell or supply samples of metal finishes at the customer’s request. These are for reference purposes only and not indicative of the exact final product/finish provided. However, they can be used by the customer to determine suitability and tested in their intended environment prior to placing an order. This is to help customers determine if the products/services Chroma Sparks provide are suitable for the customers intended use.

 

The metal finishes that Chroma Sparks produce can appear different depending upon the setting they are placed in. Factors such as lighting (natural and artificial), height and orientation can affect the overall appearance of the metal finishes. Chroma Sparks cannot be held accountable for this and it the responsibility of the customer to consider such factors prior to purchasing or placing an order.

 

 

LEAD TIMES AND DEADLINES

 

Whilst Chroma Sparks endeavours to provide the customer with their ordered parts/services within a fair, suitable and often agreed upon timeframe, our lead-times are approximations and items can be delayed from time to time.

This is often due to variables out of our control such as stock delivery delays, delays by outsourced processes, or parts having to be remade due to unforeseen damage or deemed defective.

Reasonable attempts to update and inform the customer of any such delays will be made by Chroma Sparks. However, Chroma Sparks do not guarantee products/services will be provided by a particular date.

 

Chroma Sparks cannot be held responsible for delays in providing products/services that may have come about due to necessary information not being provided by the customer. An example of this, would be if the customer failed to give Chroma Sparks updated or final information on time relating to things such as dimensions, necessary drawings/specifications, changes in dates or design etc.

 

 

SITE WORK

 

If Chroma Sparks are required to visit or carry out work on site it is the customers responsibility to ensure the site is accessible, suitably prepared, cleared of obstacles, safe, and that all necessary prior work is completed before Chroma Sparks arrive. In failing to do so, Chroma Sparks reserves the right to leave the site and remove products being provided.

In such an event happening Chroma Sparks reserve the right to charge the customer for time and expenses incurred up to the value of the agreed installation cost.

Chroma Sparks may choose to either reschedule once the site is suitably prepared or cancel the installation altogether. In such a case the products will be provided to the customer for them to arrange their own installation provided full payment has been made prior to this transfer of goods. 

 

Chroma Sparks reserves the right to cancel any planned installation at any time should we feel unconfident that the installation can be carried out successfully, safely and on time.

DAMAGED/LOST/MISUSED ITEMS

Chroma Sparks takes no responsibility in products provided being damaged, misused, lost, poorly stored or incorrectly installed once the customer is in receipt of the items. Any attempt to replace or repair any such items is at the sole discretion of Chroma Sparks and is subject to additional costs being incurred.

 

Full payment of the items and/or services will still be applicable despite any of the above being the case.

 

The customer does not own the products provided until full payment has been made. If payment is overdue or refused, then Chroma Sparks reserves the right to have the goods returned to us by the customer or allow us to collect them. Charges may occur for this.

ITEM DEFECTS

 

We make all our products to very high standard and handle goods carefully. However, by its very nature metal can have minor defects in it. This can be in the form of small dents, pitting, minor surface scratches, minor discrepancies in shape and colour.

 

We select our stock carefully but cannot be held responsible if items arrive with any of the above-mentioned defects provided they are minor in nature.

 

We feel a reasonable definition of minor in this case would be if you can clearly see the defects when stood at a 3-metre distance from the item and that they clearly spoil the overall appearance and use of the item.

The customer must inform us prior to placing an order if they require items to be produced to a higher standard than this so that we can advise if it is possible or acceptable or not.

 

 

TOLERANCES

 

Chroma Sparks pride themselves on creating beautiful and precise work. We aim to work towards ISO2768-m (m standing for medium) which is general standard metric tolerances (mm) for linear and angular dimensions. This is an international manufacturing standard.

However, we reserve the right to work to ISO2768-c (C standing for Coarse) as this standard is deemed acceptable to the nature of our work.

It is the customers responsibility to familiarise themselves with these standards. They can easily be found online by searching ISO2768

 

Chroma Sparks defers responsibility to the customer If our products are ordered and these tolerances have not been considered by the customer resulting in misalignment, the items not fitting, or the items now not fit for purpose due to this.

 

 

PLACING ORDERS AND DEPOSITS

 

All orders are secured and made final by either full payment upfront or a 50% deposit with the remainder due upon release for collection/delivery.

 

Cancellation of any part of an order once payment or a deposit has been made is at the discretion of Chroma Sparks. We reserve the right to keep payments and/or deposits made should an order be cancelled.

 

Any changes made to an existing order such as quantities required, change of dimensions, materials, finishes, design/manufacture processes or timescales by the customer may be subject to additional costs. These will be set out and made clear to the customer prior to changes being carried out or accepted.

By agreeing to proceed with the changes the customer is agreeing to the additional costs presented to them.

 

COLLECTION/DELIVERY

 

If the customer wishes to collect items ordered from the Chroma Sparks workshop, they must give prior notice of at least 3 working days. Visiting our workshop is strictly via appointment only.

Collection times and dates must be agreed upon and convenient to Chroma Sparks.

 

Customers may ask us to deliver items that have been ordered. If we agree to this, we will package the items suitably and carefully. We will then utilise a third-party delivery/courier company unless we state that we will be delivering items personally.

We reserve the right to select the third-party delivery company.

Delay and/or damage to your items whilst in the possession of the delivery company is out of our control and so whilst we'll make every effort to ensure your items arrive safely and on time, we cannot guarantee this or be held responsible once they leave our premises.

 

Once the customer receives the goods, they should carefully pack and inspect them. Packaging should be saved to one side in case items need to be sent back to us.

The customer must report any damage or defects in their items to us within 48hrs of delivery being made. Otherwise, we will assume the damage/defect was caused after delivery was made.

 

The customer must ensure suitable access for any deliveries to be made safely and effectively otherwise deliveries may be refused.

 

It is the customers responsibility to inform us of any labelling requirements needed to ensure that the receiver accepts the item prior to dispatch. The customer is liable to cover any redelivery charges caused by incorrect or missing labelling information supplied by the customer.
